Terms of Service (English version)

By placing a commission you agree and accept all Terms and Conditions stated below. Please make sure to read the entire document to clear all basic doubts and avoid misunderstandings.I, the artist, have the right to cancel and/or turn down any commission at any time if the client doesn’t follow the rules stated in these Terms of Service

1. General Terms and Conditions

1. All my illustration commissions are ONLY for personal use. The resolution of the works delivered is not enough for printing but it is enough to show in digital format. In case the client wants an illustration made for commercial use, the prices will change depending on client demands and a commercial use fee will be added. In addition, the illustration will have a resolution of 350 dpi.2. My emote commissions, both custom and YCH (Your Character Here), are also for personal use ONLY. This means that although the possibility of being used in Twitch channels exists and the client can offer them as sub rewards, the emotes are not of sufficient quality or size to be used in merch. Another type of use is Discord servers but the same rules as Twitch channels apply.3. The start of the project will take place on the next day following the date on which the client has paid the specified payment and given the visual reference (if they have any or if the artist asks for one). If the client decides to cancel the project and finish the process once the project has started, that payment will not be refunded unless there are circumstances that prevent the artist from finishing the product (specifications in section 2).4. The available slots for commissions are general. That is, if the artist stipulates on social media or Ko-Fi that there are 5 commission slots, they are filled by any client. There are not 5 slots for illustrations and 5 slots for emotes.5. Once the sketch has been approved by the client they cannot make any notorious changes (e.g. change the composition or pose, add more characters to the drawing or change the ones existing, etc.) but changes are allowed in relatively simple to modify aspects such as the base color palette. Any notorious change after the final sketch may carry an extra charge of between 5-15€, depending on the complexity of the modification.6. For the sake of comprehension, productivity and adjustment to the client's vision, the client should provide as many visual references as possible. These references may consist of single images (as long as their use is specified), Pinterest boards or visual boards. If a specific reference for an aspect of the illustration cannot be found, it can be described by giving ideas.7. To place an order/commission, the client can contact me through these ways:
Twitter direct message (@hiveevee) or Bluesky (@hiveevee.bsky.social).
Ko-Fi commissions page (link disponible en mis redes y página de carrd)8. The final product can be sent via email (which is preferable due to image compression in DMs, which negatively affects image quality) or Twitter DMs in the case of illustrations.9. In the case of emotes, delivery will be via a Google Drive link (which will be shared with the client by Twitter MD or email, at the client's preference). This is for organizational and optimization reasons.IMPORTANT NOTE: The link will expire 30 days after delivery, which means the client has a 1 month window to download all the files. Once this period is over, the Drive folder will be closed and deleted with no option to open it again except for major causes such as hardware theft or malfunction or file size failure on the part of the artist.

4. I, the artist, reserve the right to cancel and terminate the contract if I receive unfair treatment or the client violates copyright policies in the middle of the process. I also reserve the right to refuse to make a commission for personal reasons or for non-compliance with the above conditions.

3. Methods and Terms of Payment

1. Referring to point 1.3; the specified payment is the total price of the commission. In order for the artist to begin work, the client must pay at least 50% of the specified payment. This payment must be made through any of these platforms:

NOTE: Remember that the prices of the orders are in Euros (€). If you use a different currency, I recommend you to make the relevant calculations or use Wise, as it performs the currency conversions automatically

2. Referring again to point 1.3; in case the customer decides to finalize the process it should be noted that:a) Cancellation can only be made by the customer PRIOR to the start of the process. If the client has already paid a payment (50% or total) and decides to cancel on the very next day, it will not be refunded, since the artist will have started the process. That window of 1 day offered by the artist is to give margin to the platforms to process the payment and for the artist to make the proper administrative processes, receipts and revisions.b) The refund of 80% of the money will only be made in case the artist is unable to finish the process in the approximate time stipulated for reasons such as:
> Physical and/or mental health complications
> Offline work or school work (e.g. exam time)
> Serious technical problems (failure of my computer or tablet to function).
> Other personal reasons (e.g., moving, relocation, family emergencies, etc.).3. In the event that the client wishes to contribute an extra amount as a tip, this amount will not be returned under any circumstances; not even those mentioned in the previous point, as they are considered voluntary donations not subjected to the commissioning process.4. The artist has a policy of order of payment, order of service. This means that the process of the client who has paid the specified payment first will take priority.5. The client has the option to “reserve” one of the vacancies for a period of no more than 1 week from the date the client chooses to make the reservation if they are unable to pay at the time of the order. After this 1 week period expires, if I have not received any payment I will reopen the vacancy.

4. Terms of process and general estimated timeline

In reference to point 3.2.b; in the event that one of these circumstances occurs, the artist will evaluate if she can continue the work taking into account the setbacks, and may request an extension of the final deadline of up to 2 weeks depending on the severity of the unforeseen event. If the client does not accept such an extension, the artist will return 80% of the specified payment within 3 weeks.2. The total time frame for commissions is 2-3 weeks depending on the artist's personal circumstances and the complexity of the work.3. The commissioning process follows these basic steps:

If the customer commits any infringement of the previously stipulated rules at any point, even after final shipment, it will be considered Copyright Infringement. This means that all rights to the work held by the customer will be immediately retracted.

1. Términos y Condiciones Generales

1. Todas mis ilustraciones son SOLO para uso personal. La resolución de los trabajos entregados no es suficiente para ser impresa (200ppp) pero sí para mostrarse en formato digital. En caso de que el cliente desee una ilustración para uso comercial, los precios serán modificados acorde a las peticiones del cliente y se añadirá una tasa por uso comercial. En este último caso, las ilustraciones serán entregadas a 350 ppp.2. Mis comisiones para emotes, tanto customizados como YCH (Tu Personaje Aquí), son también para uso personal únicamente. Esto significa que a pesar de existir una posibilidad de ser utilizadas como recompensas de suscripción tras un paywall, los emotes no tienen suficiente calidad como para ser usadas en merch. Otro tipo de uso es en canales de Discord pero aplican las mismas normas que para canales de Twitch.3. El proyecto será comenzado al día siguiente del pago especificado del cliente y se haya aportado la referencia visual (si se tienen preparadas o si la artista pide alguna). En caso de que el cliente decida cancelar el proyecto una vez haya comenzado, el pago no será devuelto a menos que existan circunstancias que prevengan que el artista finalice el trabajo (especificaciones en la sección 2).4. Las vacantes disponibles para comisiones son generales. Quiere decir que si el artista estipula en redes sociales o en Ko-Fi que hay 5 vacantes, estas serán completadas por cualquier cliente. No son 5 vacantes para ilustraciones y 5 para emotes.5. Una vez el boceto haya sido aprobado por el cliente, éste no puede realizar cambios drásticos (ej.: cambiar por completo la pose o composición, añadir más personajes o cambiar los que ya están retratados, etc.) pero siempre se permiten cambios en aspectos relativamente fáciles de modificar como la paleta de colores base. Cualquier cambio notorio tras la aprobación del boceto final puede acarrear un gasto extra de entre 5 y 15€, dependiendo de la complejidad de dicha modificación.6. Por motivos de comprensión, productividad y ajuste a la visión del cliente, el cliente debería proveer tantas referencias visuales como sea posible. Dichas referencias pueden ser imágenes individuales (mientras se especifique su utilidad), tableros de Pinterest o visual boards. Si no se puede encontrar una referencia para un aspecto específico, se puede describir la idea en mente.7. Para realizar un encargo, el cliente puede contactar mediante estas vías:

El producto final puede ser enviado por servicios de MD o vía email (lo cual es preferible debido a la compresión de imágenes en los servicios de MD, lo cual afecta negativamente a la calidad de la imagen).9. En caso de los emotes, se realizará la entrega vía enlace a una carpeta de Google Drive (el cual será compartido con el cliente por MD o email, como el cliente prefiera). Esto es por razones de organización y de optimización.NOTA IMPORTANTE: El link caducará 30 días después de la entrega, lo que quiere decir que el cliente tiene una ventana de 1 mes para descargarse todos los archivos. Una vez finalizado este periodo, la carpeta será borrada sin opción a ser abierta de nuevo exceptuando causa de fuerza mayor como robo o fallos del hardware del cliente o archivos mal exportados por parte del artista.

4. Yo, la artista, me reservo el derecho a cancelar y liquidar el contrato si recibo trato injusto o si el cliente viola las políticas de copyright en cualquier momento del proceso. También me reservo el derecho a negar servicio por motivos personales o por el cliente incumpliendo las condiciones previamente estipuladas.

3. Métodos y términos de pago

1. En referencia al punto 1.3; el pago especificado es el precio total del encargo. Para poder comenzar a trabajar, el cliente debe pagar al menos el 50% del pago especificado. Dicho pago debe ser realizado a través de estas plataformas:

NOTA: Recuerda que los precios de los encargos son en Euros (€). Si usas otra moneda, te recomiendo realizar los cálculos pertinentes o utilizar Wise, ya que realiza las conversiones de moneda automáticamente.

En referencia de nuevo al punto 1.3; en caso de que el cliente decida finalizar el proceso debe hacerse saber que:a) La cancelación sólo puede realizarse ANTES del comienzo del proceso. Si el cliente ya ha realizado el pago (50% o total) y cancela al día siguiente, éste no le será devuelto, ya que el artista habrá comenzado el proceso ese mismo día. Dicho día que la artista ofrece entre el pago y el comienzo del proceso sirve para dar márgen a las plataformas en caso de fallo y también para que la artista realice revisiones, recibos y procesos administrativos personales.b) La devolución del 80% del dinero será realizada únicamente en caso de que la artista se vea incapaz de completar el proceso en el tiempo estipulado por motivos como:
> Complicaciones de salud mental y/o física.
> Trabajo offline o escolar (ej.: época de exámenes).
> Problemas técnicos serios (ej.: fallo de mi ordenador o tableta gráfica).
> Otros motivos personales (ej.: mudanzas, relocalización, emergencias familiares, etc.)3. Si se da el caso de que el cliente aporta una cantidad extra a modo de propina, dicha cantidad no se devolverá bajo ninguna circunstancia; ni siquiera las mencionadas en el punto anterior, debido a considerarse donaciones voluntarias que no están sujetas al proceso de comisión.4. El artista tiene una política de orden de pago, orden de servicio. Esto quiere decir que el proceso del cliente que haya realizado el pago específico completo tomará prioridad.5. El cliente tiene la opción de “reservar” una de las vacantes durante un período no superior a una semana desde la fecha en la que el cliente decida realizar dicha reserva si no puede realizar el pago en el momento del encargo. Una vez pasado el período de una semana, si el pago no ha sido recibido, la vacante será reabierta.

En referencia al punto 3.2.b; en caso de que se dé alguna de las circunstancias estipuladas, la artista evaluará si puede continuar el trabajo teniendo en cuenta los problemas y podrá pedir una extensión de hasta 2 semanas dependiendo de la severidad del evento inesperado. Si el cliente no acepta dicha extensión, la artista devolverá el 80% del pago especificado en un plazo de 3 semanas.2. Yo, la artista, mantengo derechos sobre la producción del dibujo. Esto quiere decir que, aunque la idea y concepto son tuyos, la realización de la obra es 100% mía ya que yo he asumido todo el proceso. Por lo tanto, no puedes asumir autoría sobre este.

Si el cliente comete alguna infracción de las normas estipuladas anteriormente en cualquier momento , incluso después de la entrega de la obra, se considerará incumplimiento de los Derechos de Autor. Lo que quiere decir que todos los derechos del cliente sobre la obra serán retirados inmediatamente.
